Big business group considers formally opposing Obamacare

The Business Roundtable, an association of chief executive officers of 200 leading U.S. companies, is weighing formally opposing Obamacare, which it had previously supported. - Sean Higgins/Washington Examiner

The association cited recent lawsuits by the Equal Employment Opportunity Commission against company health policies as the reason for the shift.

"The fact that the EEOC sued is shocking to our members," said Maria Ghazal, the group's vice president, told Reuters on Saturday. "They don't understand why a plan in compliance with the ACA is the target of a lawsuit. This is a major issue to our members."

Roundtable members are scheduled to meet in private with President Obama on Tuesday to discuss their objections.

The association has objected to EEOC lawsuits directed at company "wellness programs" — policies that are aimed at reducing employer-sponsored medical insurance costs by promoting healthier lifestyles, such as avoiding smoking or exercising regularly. Obamacare allows companies to reward employees who participate and penalize those who don't....

“But what you're not paying attention to is the fact that I just took action to change the law,” Obama boasted to the hecklers.

“Some have said it was a mistake for me to act. But then others remind me why I had to,” Obama said later.

“The day I sign a comprehensive immigration bill into law, then the actions I take will no longer be necessary,” he said. “But in the meantime, I'm going to do what I can to make this system work better.”...

Perhaps coincidentally DeAndre Joshua also fits the social profile of an eye-witness who gave a police/FBI statement and testified before the Grand Jury in the Mike Brown shooting case. If that were the only coincidence it might be easy to dismiss. Alas, it’s not. Out of an abundance of caution for other witnesses we are avoiding outlining the most direct connections – however, they are not in doubt....

Witness #35 would not give his real name, nor his social security number, nor his address or contact information, and would only sign his statement with an alias.

In hindsight, and against the backdrop of the death of DeAndre Joshua, the reluctance of Witness #35 might lead a researcher to understand a prescient fear was not unfounded....

Tax credit fight gives the GOP an opportunity for populism

Republicans, instead of listening to their K Street friends, ought to see the debate over expiring tax provisions as a chance for minor tax reform — and even for some populism of their own. - Timothy P. Carney/Washington Examiner @TPCarney

...In truth, Obama is playing political chess. He’s trying to outflank the GOP on the populist side. Back in 2012, he could get away with fighting for corporate loopholes in 2012. Now that opposing these breaks wins him populist points, he goes on the attack.

“The president would veto the proposed deal,” the White House said, “because it would provide permanent tax breaks to help well-connected corporations while neglecting working families.”

Obama’s attack resonated among left-leaning journalists: New York Times writer Eric Owles wrote on Twitter: “2014 Election Results: major tax breaks for corporations & race horse owners, but not for the working poor.”

Republicans could curse Obama's hypocrisy and dishonesty. Or they could be smart, and call his bluff — and then out-populist Obama.

It’s standard behavior for Republicans, but it needn’t be. The opposite approach is arguably more conservative, and certainly more of a political winner.

Instead of making permanent corporate tax credits, Republicans could scrap the tax credits altogether. This would be a tax hike, sure, but it would also make the tax code more neutral, which conservatives understand is good for the economy. And the revenue generated by closing the loopholes can be used as an offset for other tax cuts: reducing the corporate tax rate, or providing tax relief for regular people still suffering from the recession. Propose this and force Obama to defend his beloved tax credit for General Electric's windmills.

While Obama’s favored family tax relief involves more targeted tax credits, and picking winners and losers, a conservative tax cut for working families could be simpler: Cut payroll taxes for everyone. Republicans could slightly lower the payroll tax rate, or create a small personal exemption, so the working poor get to keep their first few thousand dollars before being forced to contribute to Warren Buffett's Social Security.

The next morning, the Brown family church was one of about a dozen or so buildings burnt to the ground. Worse still, a 20 year-old man was found dead....

[...] One, a 6-foot-8-inches man named Derrick Jordan — “Stretch,” as friends call him — whisked an AR-15 assault rifle out from a pickup truck parked near the entrance.

Jordan, 37, was one of four black Ferguson residents who spent Tuesday night planted in front of the store, pistols tucked into their waistbands, waiting to ward off looters or catch shoplifters.

Jordan and the others guarding the gas station are all black. The station’s owner is white.

Ferguson has seen a stark demographic shift in recent decades, going from all white to mostly black. About two-thirds of the town’s 21,000-strong population are black. By some accounts, the Brown shooting has heightened racial tensions in the city. But not at the gas station.

“We would have been burned to the ground many times over if it weren’t for them,” said gas station owner Doug Merello, whose father first bought it in 1984.

Merello said he feels deep ties to Ferguson, and if the loyalty of some of his regular customers is any indication, the feeling is mutual.

A severely moral California high school principal prohibited the football booster club from raising money by selling donated Chick-fil-A meals because this company opposed same-sex marriage. The school superintendent approved the ban because “we value inclusivity and diversity.” Up to a point. IN FERGUSON, WITNESS INTIMIDATION, LYING BY 'COMMUNITY OF COLOR'

On Monday night, after the release of the grand jury verdict rejecting indictment of Officer Darren Wilson in the Ferguson, Missouri shooting of 18-year-old black man Michael Brown, President Obama took to the microphones. “We need to recognize that this is not just an issue for Ferguson, this is an issue for America,” he said. “[T]here are still problems and communities of color aren't just making these problems up.” - Ben Shapiro/Breitbart

Obama was wrong, at least in the case of Darren Wilson. In viewing thousands of pages of FBI interviews and grand jury testimony, it becomes eminently clear that many members of the local community did make up the story about Michael Brown being executed by Wilson – and pressured others to lie to police or keep silent.

According to the St. Louis County Police Investigative Report, the mob mentality took root almost immediately after the shooting. By the time detectives arrived at the scene of the incident, there was “a large crowd of bystanders and a large uniformed police presence at the scene when detectives arrived.” That crowd included both Brown’s mother and his stepfather, according to witness testimony. The police report states, “Many individuals were clearly upset and were expressing their frustration, by at times yelling obscenities and threats, and attempting to encroach on the crime scene itself.”

It got worse:
As the scene investigation continued, there were several large groups of hostile individuals around the perimeter of the crime scene. The investigation of the scene was interrupted several times by death threats directed toward police officers and gunshots being fired by an unknown persons around the crime scene.
According to the police report, a bevy of witnesses described intimidation from the local community, as well as falsification of testimony. One witness initially told police she didn’t want to “get involved for fear of retaliation.” She said, “I don’t know these people. I have to live here.”

...At least 12 witnesses claimed that Brown was shot from behind, which was factually false. At least 16 witnesses said Brown’s hands were up when he was shot, which was factually false. One witness said Wilson used a Taser, then a gun: false. Another said she witnessed the events, but admitted she was blocks away when the events occurred. Still another witness said there were two officers involved in the shooting, and admitted she couldn’t tell what she’d seen and what she’d read about the case. One witness admitted in testimony to changing his story to “coincide with what really happened.” Another witness said that he was friends with Brown, and that Brown was shot while on his knees. When informed that such a story contradicted all physical evidence, the man admitted that he had not seen the shooting and then asked if he could leave because he was “uncomfortable.”

The looting and rioting and protesting are all secondary to the astroturfed case against Officer Darren Wilson in the first place. At least in Ferguson, one “community of color” did make this problem up. The media went along with it, ignoring the intimidation and the witness’ lying. And an innocent man, by all available physical evidence and a vast majority of the reliable witness testimony, could have gone to prison or death row because of it.

In that incident, a seemingly crazed and aggressive perpetrator managed to take Officer Smith’s weapon from him, and then use it to murder Officer Smith:
Police say a suspect shot and killed a Johnson City police officer with the officer’s own weapon on Monday morning.

Officer David Smith was an 18-year veteran of the force, police said at an afternoon news conference.

The suspect, 43-year-old James Clark of Greene, pulled away Smith’s weapon and shot the officer three times, according to police.

Clark fired at another officer, who then shot the suspect several times. Clark was taken to a hospital and later died.

Obamacare, of course, had promised that it would help make health care more affordable for everyone, but the number of people who can’t afford a trip to the doctor has actually risen three points since 2013, before most Obamacare provisions took effect.

The hardest-hit: the middle-class. Americans with an annual household income of between $30,000 and $75,000 began delaying medical care over costs more in 2014, up to 38 percent in 2014 from 33 percent last year; among households that earn above $75,000, 28 percent delayed care this year, compared to just 17 percent last year.

Being Thankful for the Left

When we celebrate Thanksgiving, after being thankful for family and friends, for health and comfort, for food and shelter; we shouldn't forget to be thankful for the left.

There is no light without darkness and without evil, the good often fails to find their own voice. It is in the presence of slavery that we remember the worth of freedom. Men and nations are forged in war; not only the war of shell and shot, but the war of ideas. War teaches us to fight for what we have. Wars of ideas teach us to stand up for what we believe.

It is because conservatives are basically hopeful and confident that we are also prone to extremes of despair. Too many us were shocked at the decline of our society because of our great confidence in it. The faith that conservatives have in America makes them vulnerable to being crushed by the latest victory of the left.

I have seen far too much despair and defeatism, too many comments that suggest there is no hope for America and the only thing left to do is pour a glass of wine and watch the sun go down. But those comments testify to how sheltered Americans are from the struggles against tyranny around the world.

Eight years of Obama is bad, but try sixty-nine years of Communism on for size. That's what generations of Russians had to live through. Ask some of the conservative activists in Europe who have never had any of the freedoms that we still take for granted whether they've given up hope. Ask people from countries where criticism of Islam can mean death, whether they've given up hope.

There are countless tales of courage over the last century of men and women who did not stop fighting, who did not stop teaching their children so that they would not stop resisting. And those stories have not ended. They continue today in Europe, Asia and South America. And those people would envy the conditions under which we fight, where we can protest without being shot or sent to prison, where we can have a shot at winning elections if we try hard enough.

Where we are, compared to 100 percent of the rest of the world, still free.

We face a hard fight, not only for our freedom, but the freedom of the world. The international left has made America its special project. It knows that if it can extinguish the hope of liberty in this land then it will drive the rest of those who hope for freedom across the ocean deeper into despair. And it wants your despair. It wants you to give up so that the rest of the world gives up too and bows under its chains.

And yet this fight is a glorious one. This fight is our birthright. And we should be thankful for the fight.

Congress has the power to defund President Barack Obama’s executive amnesty order, the Congressional Research Service announced Wednesday. This, after a week of bipartisan declarations that Congress was powerless to stop the order.

“In light of Congress’s constitutional power over the purse, the Supreme Court has recognized that ‘Congress may always circumscribe agency discretion to allocate resources by putting restrictions in the operative statutes,’” reads a report from the Congressional Research Service. The report was sent to Republican Sen. Jeff Sessions’ office, first reported by Breitbart News, and has since been obtained by The Daily Caller.

After Wilson was exonerated of any wrongdoing by a grand jury on Monday, Kelly took to the airwaves to criticize those that haven’t given the public all the facts, specifically the Rev. Al Sharpton of MSNBC....

The latter was on display at last night’s press conference with St. Louis County prosecutor Robert McCulloch, who, after announcing that a grand jury had refused to indict Ferguson police officer Darren Wilson in the August death of Michael Brown, took several questions from the gathered paragons of journalistic virtue. A sampling, with commentary:
You’ve been accused by some of passing the buck, by simply standing back and putting all this evidence in front of the grand jury rather than taking a stand. Isn’t that what you were elected to do? Shouldn’t you have taken a stand in this case?
It is no surprise that it did not occur to the journalist in question that by taking the case to the grand jury, McCulloch did in fact “take a stand” — namely, a stand against the summary judgment that so many protesters were willing to make (“What do we want?” “Darren Wilson!” “How do we want him?” “Dead!”), and a stand in favor of community oversight through the mechanism of the grand jury. That the photograph of Walter Duranty — the New York Times Moscow correspondent who deliberately whitewashed Stalin’s 1930s forced starvation of millions of Ukrainians and won the Pulitzer for it — still is on the newspaper’s wall of fame with their other prize winners is apparently no aberration. The New York Times has no moral center. In fact, it’s despicable. On November 24, they published the home address of Officer Darren Wilson....

So much for that newspaper. They’re cancer.

Not quite cancer but pretty bad is Jay Nixon, the governor of Missouri. Not only did he attempt to prejudge the case, calling for Wilson’s head like some minor league Robespierre months before there was any evidence, but then, on the night of the grand jury announcement, after having brought in the National Guard, he goes completely AWOL and doesn’t use the Guards at all, leaving the poor store owners of Ferguson to fend for themselves, not to mention the police. Everyone got to watch the results on TV.

Peter Kinder, the vice governor of Missouri, wants to know what happened. Why no Guards, when they were all set to go? Did the word come down from the White House or the Department of Justice to keep the Guards out? Nixon didn’t answer, just accused Kinder of playing politics....

But the real top of the Ferguson Hall of Shame goes to the people who brought us Ferguson from the beginning. I mean the real beginning. I mean… what happened to black America in the post-civil rights era? Why has such a wonderful group of people who fought so hard against a racist society and won, who brought so much to American (and world) culture had the guts torn out of their community? Why is what was once one of our most family-oriented groups now virtually without family, seventy percent of their babies born out of wedlock? That was unheard of when I was a young civil rights worker in the sixties. And the endless black on black crime? Where did that come from? What caused that? Forget Brown. Forget Wilson. Following the grand jury’s ruling, the “big three” (ABC, CBS, and NBC) all broke from their regular prime time programming to announce the decision. Unlike ABC and CBS, NBC Nightly News anchor Brian Williams failed to mention any of the actual facts of the case or legal rationale for the grand jury’s decision when he expressed his dissatisfaction with the case’s outcome.

Williams opened his broadcast by declaring "The grand jury in Ferguson, Missouri has failed to come up with an indictment for the police officer in the shooting of the unarmed black teenager Michael Brown." While NBC ignored all of the actual facts behind the grand jury’s decision, ABC and CBS were much more reserved in their analysis. CBS Evening News anchor Scott Pelley provided a detailed explanation for the grand jury’s decision, and even included a statement from Officer Wilson’s attorneys...

Throughout the Obama years, the notion of jobs as a bounty to be distributed to deserving peons by the Ruling Class, rather than an economic transaction voluntarily offered by risk-taking business owners, has grown more prevalent, from Obama’s infamous “you didn’t build that” speech to Hillary Clinton treating the very notion of private-sector job creation as a joke nobody should bother telling her.

Now we’ve got businesses in Ferguson, Missouri looted and burned to the ground. Their owners and operators are expected to shut up and accept their fates as collateral damage from a temper tantrum. There were heroes in Ferguson on Monday night, as well as vandals and looters, and they’re not getting anywhere near the attention they deserve. Let me spotlight two of them.


The first is someone I mentioned earlier this week: bakery owner and single mom Natalie Dubose. She was photographed in tears on the night of the riots as her shop was trashed, but by the next day she was all business, taking quick breaks from restoring her property to handle media interviews. If she didn’t capture your heart already, a WNCN News profile that reveals she’s only been in business since June, after selling cakes at flea markets to raise the money to open her shop, ought to do the trick. After I first mentioned her, readers contacted me asking if there was anything they could do to help. I directed them to the GoFundMe page Dubose created to raise money for restoring her bakery, and I’m happy to learn it has been a smashing success...



Then you’ve got the woman who went toe-to-toe with looters when they showed up to trash the local Papa John’s pizzeria. She didn’t own the store; in fact, according to the UK Daily Mail, she didn’t even work there. She just stood her ground and shoved the looters away, resolute even when threatened with violence...

I hope we hear more about the heroes of Ferguson in the days to come, because I’ve had my fill of hearing about the villains.

In case anyone is wondering, I have no idea where either Natalie Dubose or the mysterious defender of Papa John’s stand on politics or the issues of the day. I don’t care. Under President Obama’s new program to protect millions of illegal immigrants from deportation, many of those affected will be eligible to receive Social Security, Medicare and a wide array of other federal benefits, a White House official said Tuesday....

For those who work, that includes payroll taxes, also known as FICA taxes, because they are collected under the Federal Insurance Contributions Act.

The tax payments are usually split between employer and employee and include 12.4 percent collected to pay for Social Security, as well as 2.9 percent to pay for Medicare.

Federal law says that people who pay the taxes and are deemed “lawfully present in the United States” can collect benefits under those programs when they become eligible. They may also receive survivor and disability benefits.

“If they pay in, they can draw,” White House spokesman Shawn Turner said by e-mail....

The day of reckoning has arrived not just in Ferguson, Missouri, but also across America. For some, the grand jury proceedings to determine whether the shooting of a black teenager by a white police officer was justified was never about seeking justice. As widely anticipated in the media, the jury of nine whites and three blacks elected not to indict based on the evidence before them. Sadly, hundreds if not thousands of individuals descended upon this small St. Louis suburb to agitate for an outcome based on their ideology rather than the facts under consideration by the grand jury.

Even though the grand jury elected not to find Officer Darren Wilson responsible for the shooting death of teenager Michael Brown, sadly, I never believed that the gathering protesters gathered in Ferguson were seeking justice or a peaceful resolution to the case, which has roiled race relations in America to levels I haven’t seen in decades....

Finally, someone needs to stand up to denounce the violence, rioting, and looting that has besieged Ferguson since the tragic shooting occurred. I fully support nonviolent demonstration—a right enshrined in the First Amendment of our Constitution. I do not support the belief that violent protest is justified regardless of the outcome of the Ferguson grand jury. But the fact that the Missouri National Guard had to be mobilized, along with thousands of state, local, and federal law-enforcement officers, to quell potential riots and acts of violence is nothing short of a disgrace. That gun sales would skyrocket in the town as shop owners boarded up their places of business to prevent looting is a beacon of clarity that illuminates the fact that for many, Ferguson has become a symbol of lawlessness, civil unrest, and violence rather than one of seeking justice for a slain teen....

Rudy got it right: Cops save minority lives



Giuliani was over on “Meet the Press” — opening up on Michael Dyson, a Georgetown University professor and frequent critic of policing practices in Ferguson, Mo., and elsewhere in America:

“Ninety-three percent of blacks are killed by other blacks,” Rudy barked. “I would like to see the [same] attention paid to that, that you are paying to [Ferguson].”

“What about the poor black child who was killed by another black child?” Giuliani asked. “Why aren’t you protesting that? White police officers wouldn’t be there if you weren’t killing each other.”

Naturally, polite people everywhere fell into a swoon.

Well, too bad about them. Dr. Giuliani may not have much of a bedside manner, but he’s a first-rate diagnostician when it comes to criminal justice and his anti-crime prescriptions for New York City saved thousands of innocent lives — most of them black and Hispanic. GET THE FACTS.

BAD NEWS CONTINUES TO ROLL IN FOR OBAMACARE NIGHTMARE

I would be remiss if I didn’t provide my periodic update on the Affordable Care Act, lest you grow complacent to its unspeakable egregiousness. So let’s review some recent tidbits, shall we? - David Limbaugh/Human Events

...There’s more. CNBC reports that though small-business owners may have avoided Obamacare’s regulations and penalties in its first year, they’ll not be able to do that in the second year and beyond. In a recent survey conducted by payroll processing firm ADP, small businesses indicated that health care costs and complexities and the enormity of government regulations are their greatest concerns. One-third of business owners are fined annually for failing to comply with some sort of government regulation. Half of the companies paying fines don’t even know the details of the fines they’re required to pay.

There’s still more. The Department of Health and Human Services is considering changing Obamacare’s auto-renewal rules such that if you don’t take action during the open enrollment window, you may be enrolled into a lower-cost plan. That isn’t so good as it will sound to some, because if you happen to want to stay in your existing plan under these circumstances — and keep your doctors, clinics, cost structures and benefit options — you may be precluded from doing so under the reassignment. And you probably can’t switch back once enrollment is closed. As Reason magazine’s Peter Suderman observed, “a hassle? Maybe. But have faith: They know what’s best.”

And there’s still more. A new report from Avalere Health reveals that insurers have increased premiums for the most popular plans sold on the exchanges after underpricing the policies last year. The average price for the 2015 exchange plans is increasing by 10 percent.

The bad news for Obama and his socialized-medicine disciples continues to pile up. A Gallup poll finds for the third consecutive year that the majority of Americans believe that it’s not the responsibility of the federal government to make sure all Americans have health care.

The more people find out about the horrors of socialism in practice the more they reject it. That is axiomatic — even in today’s America.

Chuck Schumer: We Shouldn’t Have Passed Obamacare In 2010

Schumer, the third-ranking Senate Democrat, spoke Tuesday at the National Press Club in Washington about the Democrats’ losses in this year’s elections. He encouraged Democrats to embrace government despite their electoral crash but also admitted that the Democratic House and Senate should not have passed Obamacare. - Daily Caller

“Unfortunately, Democrats blew the opportunity the American people gave them” by electing President Obama and a Democratic-controlled Congress in 2008. “We took their mandate and put all our focus on the wrong problem.”

“The plight of uninsured Americans and the hardships created by unfair insurance company practices certainly needed to be addressed,” Schumer said. “But it wasn’t the change we were hired to make” in the 2008 election. ”Americans were crying out for the end to the recession, for better wages and more jobs — not changes in health care.”

“The Affordable Care Act was aimed at the 36 million Americans who were not covered,” Schumer continued. “It’s been reported that only a third of the uninsured are even registered to vote,” making Obamacare unlikely to win the Democrats any votes at all.

This cultural phenomenon is so obvious, one hesitates to state it so explicitly: “Civil Rights” has been re-defined to mean “whatever gives black people an excuse to hate white people more than they already do,” and the journalistic establishment is committed to inciting such hatred.

It is this last distinction — blind loyalty to the Democrat Party — which is the ultimate goal of the attitudinal training we now call “education.” Our government school system annually hands diplomas to teenagers who can barely even read their diplomas, and the bureaucratic mediocrities who run the system don’t care that their “education” teaches kids nothing useful, so long as the student learns to vote Democrat.

Vice President Joe Biden is less-than-pleased with the way President Obama handled the very-public firing of defense secretary Chuck Hagel.

As a long-time colleague and friend of Hagel from their days in the Senate, Biden appeared frustrated and upset during Hagel’s unusual Monday morning termination at the White House. An administration official told Politico the vice president was “ticked off” by the humiliating way Obama gave his defense secretary the boot.

THE FORGOTTEN SIDE OF ILLEGAL IMMIGRATION

In his speech last Thursday, President Obama had two objectives. First, a dual one: create future votes for the Democrats and gain gratitude from illegal Hispanics for his generosity. The other objective was to set a trap for Congressional Republican by making them so outraged that they would gum up the federal budget with riders that would cause him to veto it, thus creating a government shutdown for which the Republicans would get the blame, thus deflating their momentum from the recent election.

While many elected Republicans denounced Obama’s action as outrageous and an affront to the Constitution, it is also not action that is publicly popular. (A Wall Street Journal/NBC News poll shows that 48 percent oppose it and only 38 precedent support it.)

Although Republican denunciation of Obama’s unilateral move has been heated, cooler heads in the party want to pick their legislative targets carefully so they capitalize on the voters’ desire for positive action in Washington. Actions on tax reform and excessive environmental regulations, for example, are potentially strong ones for the Republicans. Hot heads on the other hand, seem to think that in-your-face confrontations, such as a threat to torpedo the federal budget, will somehow gain popularity with voters. They learned nothing from last year’s suicidal effort to shut down the government.

Time is on the side of the cooler heads, for there is little Congressional Republicans can do between now and the end of the year, for they hold only one leg of a three-legged Washington stool. Come January 3 they will have majorities in both houses.

In the area of immigration reform, there is one thing they could advance now and it is something Obama did not address. While he promised better border security (very likely it was only lip service), he did not mention the fact that government estimates are that 40 percent of the approximately 11 million illegals now in the country came here on legitimate visas — tourist or student — and simply let them expire. The federal government has no orderly means of keeping track of them so, when their visa expiration dates came along they simply disappeared into the population.

While ferreting out people in that category would be very difficult now, creating an effective solution to this problem going forward is achievable and is part of making our borders secure.

Here is how it might work: On arrival at a U.S. port of entry, the incoming person’s visa would be verified, along with a U.S. address, telephone number, and (if the person has one) an e-mail address. The owner or occupant of the address given must also be named (for tracing purposes).

Most importantly, the incoming visitor must have a return ticket in hand.

The Immigration & Customs Enforcement clerk would record the date, flight, and ticket number.

Then, say, 30 days before the visa expires, ICE would telephone the visitor as a reminder of the coming deadline. ICE personnel nearest to the visitor’s address would be alerted to pick up said visitor if he or she has not departed by the date on the return ticket. Any visitor who is on hand and has not left will be held for immediate deportation.

Republicans in the House could easily pass this element of reform and GOP members could introduce it in the Senate. Then, let Harry Reid and Obama explain why it is not a good idea.

While Americans are focused on what delicious foods they’re going to eat for Thanksgiving, the White House is focused on releasing its massive regulatory agenda — marking the fifth time the Obama administration has released its regulatory road map on the eve of a major holiday.

The federal Unified Agenda is the Obama administration’s regulatory road map, and it lays out thousands of regulations being finalized in the coming months. Under President Barack Obama, there has been a tradition of releasing the agenda late on Friday — and right before a major holiday.

“It’s become an unfortunate tradition of this administration and others to drop these regulatory agendas late on a Friday and right before a holiday,” Matt Shudtz, executive director of the Center for Progressive Reform, told The Hill newspaper....

“It’s unfortunate because it’s an update on protections for Americans of all stripes,” Shudtz told the Hill. “It lays out the administration’s plan and it deserves more attention.”

But the White House may have a good reason to do so because its Unified Agenda for fall 2014 includes some 3,415 regulations– more than the last regulatory agenda, and one that includes 189 rules that cost more than $100 million.

The difference between the Republican Party and the Democrats today is over the rule of law. When President Obama appointed judges without Senate approval, made environmental law without Congress, and rewrote his health law two dozen times, Republicans protested that Mr. Obama was shredding the Constitution.

Most Democratic lawmakers turned a blind eye to the Constitution they swore to uphold. Last Thursday, Mr. Obama opted for lawlessness again, dictating broad changes to immigration law. He made them banana-republic style: one man ruling with the stroke of his pen.

The phrase “banana republic” was invented by the American fiction writer O. Henry, in exile a century ago in Honduras. It was a country where laws were changed frequently by petty dictators. Mr. Obama says he’s acting alone because Congress waited too long. But the Constitution vests all legislative powers, including immigration and naturalization law, with Congress. It doesn’t say “unless Congress waits too long.” There’s no timetable.

Republicans are condemning Mr. Obama’s latest power grab. Predictably, only a handful of Democratic lawmakers have said they were worried about the president’s dictatorial approach. Most are applauding him for getting something done. The framers of the Constitution were worried about presidential power grabs. They were steeped in the history of European despots, and invented a system of checks and balances to keep power-hungry presidents in line.

The problem today is bigger than one lawless man. Democratic Party leaders – half of the nation’s political establishment – talk a lot about rights, but not about the rule of law. The Constitution isn’t on their radar. No matter where you stand on immigration, this growing indifference to the Constitution is alarming. It’s given Mr. Obama license to pursue his dangerous course and future presidents to do likewise. KEEP READING
